So the two legal theories used by the FEC and AG Bragg overlap on any expenses that are personal expenses under the FEC ("could exist without an election") and campaign expenses under the NY BoE ("related to a campaign in any way")
This would de facto criminalize anything that falls inbetween these two standards, as you're either paying with personal funds (a NY state crime) or campaign funds (a federal crime)
what sort of expenses would fall into this category?
Haircuts are the obvious one since its the FEC's own example, a haircut can earn you votes, or lose them for you (citation: stewart mills iii)
but I imagine it would go much farther than that. Personal hygiene of any kind, grooming, nails, etc. Not just salons and hairdressers but presumably all shopping for such materials needed, even just buying a bottle of shampoo at walmart. The FEC's own webpage lists examples of personal expenses that fall in this gap, including household food items and supplies, funeral and burial expenses, clothing, tuition, mortgage/rent, entertainment, dues, feeds, gratuities. It seems that all of these could influence an election in one way or another. After all, politicians very publicly eat foods in Iowa for the express purpose of gaining votes, just look at that infamous photo of Michelle Bachmann chomping down on a corn dog. Or anything AOC wears. The FEC lists meal expenses, childcare, travel, vehicles, and much more.
I humbly propose that in order to satisfy the terms set by Alvin Bragg in this prosecution, New York politicians and all federal office-seekers who campaign in New York must now live a life of total asceticism, forsaking all worldly conveniences and pleasures. They must subsist only on meals that can be attained for free- and presumably this cannot include illegal campaign donations from charitable organizations that aren't permitted political expenditures, so we're talking whatever they can find in trash cans or mice they can skewer and roast. Politicians will not be allowed to engage in any personal hygiene or grooming that costs money or requires purchase of materials, nor any services provided by other parties as these would constitute in-kind donations, a thing of value. They are no longer allowed to travel nor pay to rent, purchase or maintain property, so they must live indigents. I propose that to create accommodations for our new politician class, a public space be set aside in public parks for politicians to assemble their shanties built out of whatever materials they can scrounge freely from nature. Unlike the normal homeless, we'll actually prosecute them for panhandling or begging as these would constitute felonious acts of campaign finance fraud.
