understood but that's not how this works. originally the out past curfew charge was on the docket, that WAS an open/shut case.

but being out past curfew doesnt make another charge open/shut.

that would be like saying a woman who's naked can't claim rape because she's naked. extreme and not at all equal example, but its just not how the law works.
