There is absolutely no hypocrisy here with how the DOJ is handling Trump vs Biden. It is patently obvious they bent over backwards for over a year to allow Trump to return the documents, and only took action when Trump willfully withheld documents and lied about it.

If Trump had just returned the documents when asked, or simply not obstructed them in retrieving the documents by hiding them then he wouldn't be getting charged.

they pussyfooted around till they could use it for election interference

Said it when the raid happened and I'll say it again.

This is the most open and shut case you will ever see. There is no grey area. There is no two sides. Trump is wrong, and the government is right on every single facet of this case.

The FBI, DOJ, and NARA bent over backwards far beyond what was reasonable to allow Trump to return the documents. Trump actively hid the documents, probably destroyed a bunch of them, was showing them to his friends as a brag, and even lied to his own lawyers about returning all the documents. We literally have texts between his family, his staff, and himself coordinating moving the documents off site. We literally have him showing the documents around. We literally have him on tape admitting he didn't and can no longer declassify the documents.

There is absolutely no reasonable defense for Trump. The only conclusion in Trump's favor must therefore come from dishonesty, ignorance, or stupidity.

Goverment is frequently wrong, but in this specific case, they are entirely right.

It's pretty rare but it does happen sometimes.

Can a President declassify documents related to nuclear security?

He’s the head of the executive branch, he has plenary powers in regards to this. The constitution is clear on this issue. So is the judges ruling in the Clinton case

Even if Trump declassified every record he is accused of taking it would not make those documents presidential records.

https://www.archives.gov/about/laws/presidential-records.html#2201

Here's a link that tells you what a presidential record is.

I think you’re confused with this… the tapes have classified material and declassified material on it. That was not under the FOIA access, which means 1 of 2 things… also to note the executive branch doesn’t answer to the archivist that much has been made clear.

My understanding is that via The Atomic Energy Acts of 1946 and 1954, not even the President can declassify information related to nuclear security.

The classification status is irrelevant to this discussion. Trump's documents are not presidential records as they are departmental documents which are explicitly excluded from being presidential records.

If Trump had been found with handwritten documents detailing classified information then you could maybe use that as case law in support of Trump, but that isn't what's happening.

Twitter thread with videos showing Bill Barr on Fox News Sunday. His argument that he was with Trump against the Russiagate stuff but departed on January 6th and the classified documents case seems like it would be appealing to voters who are only partially infected with FoxNews-brain and aren't full Trump cultists.

What's great about the cult is that even after Trump is recorded on tape admitting he has documents that are still classified, and that as an ex-president he has no declassification power, they still run with his defense from months ago.
