The government was in error when it deported him in violation of his withholding order, but the government was also negligent in not reprocessing his case and voiding that withholding order as El Salvador negated its premise (or you know, just overturning it in the first place as a fucking insane ruling). The only 'remedy' available to him now is entirely conditional on a foreign power releasing him for no reason, and would result in nothing but him being bounced around the immigration system and detained for as long as it takes to deport him right back and get reimprisoned in CECOT.

Democrats really know how to pick'em don't they. An MS13 human trafficker and wife beater joins the pantheon of saint floyd, travyon, garcia zarate, luigi mangione, etc. Why does this guy deserve any particular attention at all? His case means nothing, there are no stakes, there is no harm. There's no controversy to resolve, no judgment to be decided, no outcomes to be changed. A liberal judge can try to pick a fight with the constitution and see how effective it is to hit one's head against a stone tablet.

i personally think the courts will re visit the constitution and claim "peoples" only applies to citizens. should also limit asylum in the future to avoid our courts being held up for 20 years while citizens foot the bill.

Here are the data points we have to work off.

In 2019 he was arrested in the company of three men, two who were known MS13 members with long rap sheets and many gang convictions. They had drugs on them and were identified by an informant as 2 existing gang members and 2 new recruits. He was wearing specific MS13 colors, the hat they use. There is no way MS13 members would allow him to dress up like that and hang out if he wasn't a member. The government formally accepted this as an identification of him as MS13 as grounds to deport him and add him to the terrorist watch list. But barred that deportation due to the threat of the rival Barrio 18 gang.

In 2022 he was detained driving a vehicle with 7 migrants- almost certainly other illegal aliens- taken from the Texas border, all the way to Maryland. He was identified as an obvious human trafficker by police, driving without a license and on the terrorist watch list. The Biden DoJ let him and all the illegals go free

He was also the subject of a domestic violence restraining order as he was beating the wife he married just to give him a better chance at dodging deportation, and threatening the kids she had as a single mother before marrying him.

Given this as our limited window, the weight of evidence is clearly to him being an MS13 member. Which is also irrevelant to his status because he's an illegal alien and subject to deportation either way, and his withholding order both now defunct and nuts in the first place. Being an MS13 member only matters to his status in El Salvador, where they will keep him locked up at CECOT.

I can’t help but feel the same people who want to give due process to people who aren’t citizens are the same people ok with not giving child molesters the death penalty.

The US has become way too soft and accepting of certain things but really doesn’t owe any non-citizen or someone who commits a heinous crime anything. Now, you have people that will start “the constitution says…” but those same people will turn around and say that the second amendment was written too long ago and needs to be altered. The fact is they are partially right.. some of these rules are old and need to be relooked at.
