Simple.

Smoking bans violate the 1st amendment right to freely associate combined with the 14th amendment equal protection clause because (we assume anti-smokers concede that people can smoke in their own homes) I can smoke in my own home if I so choose, but that same right is denied to the bar owner.

Aside from the fact that NAACP v Alabama is what I was consider a misinterpretation of the 1st amendment, in what way does limiting the areas where smoking is is permitted a violation of the "right to freely associate?"

Food for thought. There's more than 1000 chemicals in a cup of coffee, and only 22 of them have been tested for cancerous properties.

you drive to work? you probably inhaled somebody's engine exhaust --> thats more "dangerous" AKA damaging to your health...


judging by the millions of people that drink it... i doubt there is much harm that can come from coffee in moderation (though jitters are annoying and high blood pressure could be dangerous to somebody at risk for a heart attack)

Yeah, I've been the one making "points" about people who drive versus people who smoke these entire last couple threads

There should not be any arguement as to the safety to cigarettes; or even the state of their legal status, at least as it stands now. It makes no sense

If i went outside and had this bottle full of carsonogenic chemicals and started spraying it all over the place in the streets etc; i would probably be arrested, fined etc. But its okay when its cigarettes?

You might stand some danger from second hand smoke if you were sucking the air out of the smokers lungs. It's really not that big of a deal.
