There's nothing in either the PRA or Espionage Act that says your notification or volunteering matters. There is however a part of the PRA that says NARA has zero authority to decide what is or isn't classified, which is left solely to the president.
The three letter agencies didn't spend Bidens years out of office trying to dig into him and find an excuse to lock him up. He had those documents in his possession, he didn't disclose them, he even publicly lied and said he had none and the agents kept finding more. Nothing in the espionage act excuses that, and nothing in the PRA criminalizes that, and in a sane world neither of them should be weaponized against a president or VP for having papers from his own administration, especially not for information he already had in both his possession and his total control from being the head of the government in the first place.

The FBI was already acting as Biden's personal secret police while Trump was in office, its no surprise they're keeping it up now he's at the helm.

Never said it did. I said it's why he's charged and the others weren't.

By the letter of the law, Hillary, Biden, Pence, and Trump all broke it. I'd hazard a guess that small offenses like accidentally keeping documents after you are out of office happens pretty much constantly which is why they almost never seek charges.

But the reason Trump is the only one charged is because what he did was like a thousand times more severe (knowingly storing military secrets in unsafe locations, actively obstructing when asked to return them) and after being given over a year to comply he continued to actively obstruct their retrieval.



The FBI bent over backwards to accomodate Trump through this entire process. It's pretty pathetic that you keep trying to paint them as corrupt. Just shows how dishonest you are.

My compliments… you’re the only one so far I’ve seen in the thread arguing on the substance of the law and how’s it’s written in regards to PRA, the espionage act doesn’t even apply to a President let alone a former President. The President does not operate through channels other members of government need to. OBVIOUSLY there are checks and balances but this is not one of those circumstances. I’m amazed at the regurgitation from people. “I read the indictment” all 49 pages?

There is a misconception on what a grand jury is… you only need a simple majority and there is no counter and or rebuttals to anything the prosecution says or does. Even if it’s overreach or violation of the law. It’s really a terrible injustice to the justice system

The espionage act absolutely applies to former presidents.

What are you smoking?

Do you think 49 pages is a lot? It isn't. Its less than 30 minutes of reading. And a lot of it is repetitious anyway. And if you don't want to read it yourself there's plenty of channels with videos reading it already

Please cite where in the espionage act it carves out an exception for former presidents. (I'll save you time it doesn't exist)

Current presidents cannot be charged with sharing information to uncleared parties because they are the ones at the top of the chain that determines clearance levels, but once you are no longer in that role you are the same as any other citizen when it comes to criminal liability for sharing information

Where did you get that? The document is litteted with the word "whoever", and grants no special protections or exemptions for an ex-president.
