to be clear here, i think the officer has legal immunity and the case will be settled that way. out of court civilly, not criminally. then again, chauvin happened.
but from my viewpoint its more of a garner v TN case, she's a fleeing felon. his fear of life claim to my is bogus, even though i know caselaw will likely disagree. he got barely nudged so he's in the clear legally. he's still a trigger happy idiot who never should have been in the front of that car. bad training, worse trigger discipline.
Huge difference of state vs feds. The state paid millions to the family of the cold blooded murderer who got killed whole fleeing officer Kim Potter. But this womans family could sue the feds all day long and not get any obama bucks. You can see the vehicle was lined up with the officer, the tires are straight, she threw it and drive and hit the gas and her tires spun out on ice. That moment was when he reacted and chose to use deadly force and justifiably so, the near miss or minor collision and her turn were all split second outcomes that we can't expect people to anticipate. The same icy road that had disabled the vehicle they were trying to extricate probably also saved this guys life when her lack of traction stopped her from lurching 20 ft forwards into him. And besides the case law making it abundantly clear officers have no obligation to avoid putting themselves in front of vehicles or use least intrusive force (Bowcutt), its also just basic human decency and road safety and "not being a murderer". I mean shit are we supposed to gun it and mow down anyone who jaywalks in front of us at intersections while stopped? She was blatantly ignoring the safety of bystanders and pedestrians. She had no idea if anyone was behind or to the sides of her, she didnt stop and check blind spots, she was surrounded by people and chimping out
