He's proved that he means to do harm by breaking in with the gun, I'd shoot him, depending on the circumstances of the shot and who else is in the room I'd like to think that I'd try to disable him not kill him, but if my wife or kids are within his sight he's dead.

sure your kids would appreciate that

Where i live (Oregon state), it is not legal to kill somebody for simply breaking in. If i felt that my life was in danger by said person (like if they had a gun), then i would not hesitate to kill them as It would be legal self defense. My decision to kill or not kill is not based on any ethics or morals, but rather the laws and the corresponding consequences of those laws.

Always shoot to kill. If you do not intend to kill a person, you have no business pointing a firearm at them. Unless of course you have no regard for the law - in which case, you're on your own, criminal.

I'd venture to guess that you do not understand US laws. Its not legal to point a gun at somebody unless you are also within the legal right to shoot and kill them.

...a police officer has the right to detain a suspect at gunpoint...he does not have a right to shoot the detained suspect .

OOH a police officer, now your taking about something entirely different. This topic was about citizens using firearms, not the above-the-law police. Police of course are subjected to entirely different rules.
