The amendment in question has NEVER required a conviction, and in fact this is an open and shut case.
He told them to go to the Capitol, but he didn't tell them to storm it or use violence. Trump has often times rallied his supporters to the streets for demonstrations; you will have a hard time proving that he explicitly meant violent insurrection in this particular instance, rather than ordinary protest. Morally speaking, Trump is guilty as fuck. I'll happily admit that. But legally, his culpability for the actions of his supporters is not as clear.
Also, this argumentation by the anti-Trump side stings particularly against the backdrop of the Summer of Love in 2020 when plenty of Democratic politicians explicitly condoned the use of violence by demonstrators from their own side during the BLM protests, the attacks on the Portland courthouse and so on. If public calls to one's supporters to use violent protests and a breakdown of public order to further one's political goals constitutes an insurrection, then Pelosi, Waters et al. are guilty of it too.
My other points of course still stand: there is legal debate about whether section 3 of the 14th amendment actually applies to the presidency to begin with; and it is politically unfeasible to bar a candidate supported by nearly half the country from running without inflicting huge damage to the democratic process (if not even outright triggering a civil war).
