It's not codified into law. It is legal because of a SCOTUS decision. The SCOTUS decisions used to set precedent and then the cases were considered to be a "resolved matter," but recently SCOTUS changed their minds, so there is a push to codify certain things into law so that SCOTUS can not alter their decisions after setting a precedent.
