If they were enlisted in the Ukrainian military then they are soldier prisoners of war.

If they just went there to fight Russians (or Ukrainians) then they are definitely 'enemy combatants' by our definition of the word. The US has made it flat out illegal and has made the tools to persecute any men who are soldiers of fortune/mercenaries. You have to commit to the forces of a state like The French Foreign Legion which hasn't seen any action in a decade. You would just waste away being policeman for poor people instead of being a soldier.

As a combat arms veteran and person able to fight I felt the urge and guilt for not going to help the free people defend themselves. I've spoke to other ex-soldiers and marines and they feel the same. All American service veterans wish they were there to some degree helping the Ukrainians against this blitzkreig.
