Honestly, any competent lawyer will make this defense since it also prevents lawsuits in the future. Even if it has little chance of succeeding.
The difference here is that Tucker Carlson is obviously opinion, and Fox News has always drawn a hard line between their opinion and news segments.
NYT does the same, but here we are specifically talking about an article published as news, which NYT policy insists does not contain subjective elements. Readers are therefore led to believe that what they're reading is "fact", opening up the NYT to libel suits.
