Freedom of speech is inarguably stronger in the United States. The Brits and the Europeans will jail you for speech that is completely protected here.

Are you certain? He's offering $500 for people to murder illegal aliens. It's incitement AND there are plenty of people who'd be willing to kill for money. IIRC the test is whether it's a direct call, and there's imminent likelihood it could happen. This appears to fit the bill.

The second sentence is a conditional based on the first sentence.

There's a world of difference between psychological evaluations being used to exclude you from eligibility to buy/bear arms and being used to include you into eligibility. Imagine being told your rights were on hold until you "proved your innocence" instead of the state "proving your guilt."
