"Asians are not people of color" - does this also apply to Indians and Pakistanis, who often times have darker skin than many US-born blacks?

This indirectly admits that skin color is not the central factor explaining differences in educational attainment - wealth/culture/education levels of the parents are. Which is a blatant contradiction of the official liberal narrative that differences in educational attainment between different races are caused by outright or internalized racial discrimination. (Which is the official justification for reverse race-based discrimination via affirmative action.)

It could just be that the categories were fudged because the educational attainment of asians is very similar to whites, so would represent a similar line on the graph, and therefore not be of much use? Clearly they don't think asians are white, otherwise they wouldn't have mentioned it in the legend.

That's beside the point. It is impossible for race/skin color to be the decisive variable explaining differences in educational attainment (which is a prerequisite for affirmative action) while dark-skinned asians are, at the same time, lumped into a group with whites.

On the contrary, the fact that many non-white asians perform as well as whites (or even better) in education is strong evidence that other factors than race are the key determinants of educational attainment.

No, it's not. It clearly shows that race is an unsuitable proxy for the factors behind the educational disparity.
