You're description of justice is of retributive justice. Restorative justice factors in the wishes of the victims. One has led to mass incarceration.

Really you gotta take a step back Im not really trying to determine what the punishment itself should be that was the example to illustrate the importance of not allowing conflict of interest, its more the rules and how they are defined, not defining ramifications for breaking those rules.

I'm not sure I would write this down as 'biological' differences due to the plethora of factors impacting an individuals health. Correlation yes, Race based biological causation... eh.

Think the stronger cause link is with cultural norms within the study group, habits, diets, and activity.
