8 cases left to decide, after which we roll the dice to see if anyone retires
they're in progress right now releasing the opinions
https://www.scotusblog.com/

First case:
https://www.supremecourt.gov/opinions/19pdf/19-631_2d93.pdf

The exception to the robocall restriction law that allowed debt-collection calls for debt to/guaranteed by the US is struck down as violating the first amendment, affirming a lower court that said it was not content-neutral and didn't survive strict scrutiny. They agreed that political robocalls being banned while debt collection was allowed favored one type of speech over another. "As a result, plaintiffs still may not make political robocalls to cellphones, but their speech is now treated equally with debt-collection speech." The anti-robocall act is allowed to stay and is not invalidated, but the special exception for debt collection is struck down

Faithless elector case just in

Kagan writes for a 9-0 opinion, 7 majority + thomas concur + gorsuch concur
States are allowed to force electoral college delegates must vote for the president, allowing them to outlaw faithless electors:
Quote
"A state may enforce an elector's pledge to support his party's nominee--and the state voters' choice--for President."

/e and that was it. Herp a derp, 2 opinion day, what a tease
guess I'll recycle this thread when they return tomorrow

still up: ACA contraception mandate, Trump tax return case, ministerial discrimination exception, Muscogee sovereignty case, uh a few others idk

its time for new decisions, right now

First decision:
https://www.supremecourt.gov/opinions/19pdf/19-267_1an2.pdf

Our Lady of Guadalupe School v. Morrissey Berru.

Held: The First Amendment’s Religion Clauses foreclose the adjudication of Morrissey-Berru’s and Biel’s employment-discrimination
claims. Pp. 10–27.

Alito, Roberts, Thomas, Breyer, Kagan, Gorsuch, Kavanaugh hold the majority 7-2, favoring the ministerial exception
Sotomayor, Ginsburg dissent.

Alito writes for the majority, meaning there can be no more decisions penned by Kavanaugh, Gorsuch, Kagan or Sotomayor today, leaving an unknown number of cases with majority opinions by Alito, Thomas, Roberts, Breyer or Ginsburg;

Quote
This is a case about whether courts can hear employment discrimination claims brought by two teachers at Catholic elementary schools, or whether the teachers’ lawsuits are instead barred by the “ministerial exception,” which bars ministers from suing churches and other institutions for employment discrimination.

Held: They may not sue for employment discrimination, as the institutions are protected by an exception for religious institutions under the first amendment

unlikely to announce all decisions today, they didnt' announce its the final day
4 remaining cases

won't be any surprises, the right wing activist judges, who pretended to be 'originalists', but at the first opportunity abandoned case law to further their anti choice agenda, will continue their crusade against women, the working class, and fair elections, as predicted.

final decision for today, and its the related case Little Sisters of the Poor v. Pennsylvania.
majority is written by Judge Thomas

https://www.supremecourt.gov/opinions/19pdf/19-431_5i36.pdf

it is the "religious exception to the Obamacare contraceptive mandate" case;

Quote
This case is a challenge to the 2017 rules issued by the Trump administration that expanded the exemption from Affordable Care Act’s birth-control mandate, which generally requires employers to provide their female employees with health insurance that includes access to certain forms of contraceptives. The rules expanded the exemption to allow private employers with religious or moral objections to the mandate to opt out of providing coverage.

and

Quote
"I would hold not only that it was appropriate for the Departments to consider RFRA, but also that the Departments were required by RFRA to create the religious exemption (or something very close to it). I would bring the Little Sisters’ legal odyssey to an end"

'We hold that the Departments had the authority to provide exemptions from the regulatory contraceptive requirements for employers with religious and conscientious objections."

The Third Circuit ruled that the various federal agencies lacked the authority to promulgate the exemptions. "This decision," Thomas writes, "was erroneous."

so the roundup for today:

1) Religious employers may not be sued for employment discrimination under the ministerial exception
2) Private employers may cite a religious or moral objection to not be required to provide contraception / equivalent coverage to employees as otherwise required by Obamacare

I'm more encouraged by the ministerial exception decision, especially since it was 7-2.
