Well, when I went to school, they taught all three branches had different powers, but came out equal in the end.

Yeah separation of powers, still the same thing we learn, don't know what my teacher is smoking.

To begin with, Congress certainly has more power than the president. For example, Congress is the body that practically created the executive departments. If Congress wanted to, they could disband these executive departments such as the Department of Education or the Department of Homeland Security. Congress created these departments and could take them away if there was a will to do so. Also, Congress could also take away power from the president by withholding money. When thinking about it, if everyone in Congress worked together and unified as one, they could literally pass any law they wanted to. The president wouldn’t be able to pass laws himself, and the only way he can stop a law passed by Congress is a veto which would potentially be overridden. The Supreme Court also makes sure that the president is in check and does not have excessive executive privilege.

This is what I have so far attempting to prove this LMAO.

On a purely theoretical basis, Congress is clearly more powerful than the Presidency. The president is accountable to Congress, not the other way round. Congress could impeach and remove from office any president it doesnt like, while the president cant disband or fire Congress.


In reality, Congress will almost always be so split along partisan lines that the threat of impeachment on ideological or policy grounds is effectively non-existent. Furthermore, in reality, the president is the leader of his party and thus holds substantial sway over senators and congressmen from his party, who are at risk of getting primaried if they stick their heads out too far against their president.

In general, in an era of hyperpartisanship, Congress will be gridlocked most of the time, which increases the relative power of the presidency and its large autonomy on foreign policy, EOs and such.
