okay i think i might get it fixed
apparently you cant mix the DD versions with CD versions
i had to DL classic because lost disk but not key
and i was using LoD disk
so here goes :)

gnarf @ blizzard resetting SC II beta accounts. was just glad that I had that cool space marine portrait :D
