Scalia is a moron. What a bunch of outdated and ignorant slave owners drummed up inbetween pints of hardened cider is merely a basis for a system of law, not its purpose and ultimate destination. Its a crude means to an end.
It doesn't matter one iota what anyone wrote nor intended, only what is right and wrong and to hammer out those find edges to best serve the public good.

Law does not serve right vs wrong .... Law is a means of controlling society and keeping it cohesive and obedient.



On the topic at hand ... I think incest is disgusting and revolting and has no place in society ... But if a grown man and woman or man and man or woman and woman etc consent and want to do some strange shit in their bedroom ... I don't think it's anyone to legislate the conditions of that sexual encounter based upon the fact that they are related ... I'd hate if someone decided my sexual activities were illegal because they disagree with them.... So i could never support doing it to someone else.

Incest isn't a huge deal between consenting partners. It's also very common. Most studies on the topic say a sizable minority of people have engaged in or had thoughts of incest, for the most part bring consensual. It's a taboo but not really a prosecutable offense unless accompanied by sexual assault.

That's a few things we should agree on. Cousin incest isn't an issue (almost no health risk for children). More controversial, taboo as wrong is based on subjective morality, you cannot say it is objectively wrong in a vacuum. When it is associated with child abuse yes but it is not inherently that.

Child abuse is objectively wrong though, right?
