So police killed a hostage with 10 gun shots.... But the survivng gunmen was charged with murder? Did he murder someone other then the hostsge?

The report doesnt state anyone else (other then the 2 other gun men and the hostsge) being shot and killed.

I had to do a bit of searching but they are claiming the person killed was used as a human shield. Dont get me wrong, he deserves to face jail time for his crimes... i just can't help but wonder why he is getting murder charges when it was obvious police negligence that got the woman involved killed....
