Laws like this will discourage promiscuous gay men from being tested at all. Getting tested is just exposing yourself to legal risk as long as the gay disease is being treated different than any other disease.
It would be the government just acting too late and ineffectively as usual.
Why does this have to have any relation with sexual orientation?
If you are HIV-positive, know about it and expose your sex partners repeatedly without their knowledge, you should be tried for "physical injury resulting from negligence".
If you expose them repeatedly, and an intention to spread your HIV can be proven in court, then you should be tried for attempted murder.
All of this works irrespective from if you're hetero, gay, lesbian or anything else.
