Doesn’t Blizzard still sell it? I thought it came with the Diablo 2 battle chest at one point as well.

If not, maybe an auction site?

Unfortunately you can no longer buy a copy of Diablo 1 from Blizzard and their associated providers, the game does not come with a CD-key to be used on Blizzard's website, and there is no paid digital download option.
According to Jurannok, a Blizzard representative on their Support Forums, the game has been discontinued and Blizzard has no current plans to update it or start selling it again. Sources:

As far as I am concerned, that makes Diablo 1 abandonware.

The internet or internet auctions - those are the only way.

for real =?.... ofc i allready know that ... why u think i am asking here :D? i had it installed but thanks to some friends who wantet play rubish games with me and broke my laptops base so i need to format him and then it was gone .... so anyone has a cd cd immage of it?

No one can provide a CD image - unless the game has been classified as freeware by Blizzard, that would be piracy.

Did Blizzard make Diablo 1 freeware in addition to discontinuing it? If not, your only option is a second hand source such as auctions.

As far as I know the only way to get Diablo 1 right now is to buy it secondhand like Cyrus said. My older brother bought a copy at "GAME" in Sweden a year or two ago when they ran out of buissness in my town so they sold out everything they had on shells and behind the disk.
But I have never seen it up on the shells so they most likely had some copys laying around for a loong time.

If you can't find it with that certain piracy program, then go to ebay and buy it.

Just buy original game as all users are buying games for they consoles/computers.

For example i bought -HELLFIRE- datadisc for DIABLO some months ago..
Its 20 years datadisc CD ^^
And its rarity over diablo cd, u can see diablo more often in auctions/bazaars im sure you get it
