The new ladder is always announced in game and on their forums. You can also check out the Official Diablo Ii Ladder Reset Information in the Diablo 2 Discussions section that contains the official blizzard post.

I am sure they will do a new patch if it's going to have downtime.
I am also sure there was FAR less characters to migrate over from ladder to non-ladder with the recent changes to ban cheaters.
