The EU knew May would back down because she was too rational and moral to knowingly inflict the damage of a no deal scenario on the British people, but they also know Boris doesn't have anything to lose.
May would never have broken or even threatened to break international law, but would Boris? Maybe...we just don't know. He's unpredictable. If we get a deal, Boris looks good. If we leave without a deal, Boris can blame the EU and say he stood true to the will of the British people and delivered on the referendum result. Giving in to EU demands is actually the least enticing option for Boris to choose if he's just thinking about his own reputation rather than for the benefit of the country, which we all know to be true.
Therefore, even though I dislike Boris far more than I did May, he has done a lot better in the negotiations thus far because the EU can't reasonably call his bluff. It would be a shame to see negotiations fail in the final hour over such minutia but the fact it's minutia and not significant relative to the overall deal is why I think a deal is going to be agreed.
