you can but when the bug triggers it won't open ther merc'c inventory. when you rejoin an empty game it's accesable again. when the merc dies and you resurect him too but then it looks empty (like Marieusz explained in detail)

When you resurrect him and his gear has poofed it is display only, he is still wearing the same items, if you try and then equip an item you replace the one he is currently wearing, so no stacking exploit, trust me I tried :P
