If you want to discriminate against the public, nobody is stopping you from starting a private, membership based company that caters to specific races, classes, genders, or religious affiliations. It is totally legal in the United States to run a private business that doesn't allow blacks to drink from their water fountains, for example, if it is a private membership business.
But if you want limited liability protection from the state and you want to charter your business with the state in order to take advantage of corporate status, and you are using government resources and government power to run your public facing business, then you have to follow nondiscrimination laws and operate within the confines of a public-facing business.
It's pretty simple really. If you despise the state and believe in private enterprise and the superiority of the business owner to discriminate, nobody is stopping you from doing so in this country.
But if you are an intellectually inconsistent bigot who wants all of the benefits of a state chartered public facing business, you can keep your filthy racist, misogynistic, transphobic opinions out of it.
There have been plenty of lawsuits against private membership organizations based on discrimination and what constitutes public accommodation. Last time I checked, he pays taxes, "government resources" are his resources.
Secondly, he never denied customers sale, they can buy all the cakes they want, he denied them a custom, unique service based on his skills. A very specific request to his labor in a business that offers more than just custom work. You can deny a contract that isn't in your best interests. Web designers don't have to create pornography sites just because someone requested their services.
