Well, for one, we have the Constitution. I'd like to remind you that we are pretending that the Constitution does not exist.

Remember, the Constitution is just a set of rules that MOST people agree with (see amendment process).

If enough people in America AGREED that it should be law, then yes, it would be acceptable to ban atheism.

...as TC already pointed out , if enough people can be convinced to make it illegal it can be done . If the courts interfere the political process exists to overrule the courts .
