While the behavior is reprehensible, I think the bold just constitutes grounds for termination of that specific employee, not legal action.
Depends. I think if you say something fairly neutral (e.g. not super graphic) and the person says "yo, don't say that around me," and you don't, that isn't. If you do it again, then it is.
But then again, I'm a decently rational human being, so what do I know?
