show me a case where someone went to jail without probation or bail, for the first day or instance of stalking, without a criminal background in this direction.

You can be arrested for menacing.

To be clear, there has to be no threat of violence for it to be menacing.

It's super misleading because he was let out with no punishment other than 'time served' and they phrased it in a really goofy way, near as I can tell. The problem here is mostly that our court system is so backed up and that bail is basically extortion.
