??? expert counsel can have differing opinions. just because they didn't agree with the ACLU's interpretation does not make it unconstitutional on its face. national security agencies do not determine what is constitutional and what isn't. if that was the prevailing opinion the NSA/CIA would have unlimited power that would not be checked by the courts.

No, he's CLEARLY not. The posed hypothetical was if another POTUS issued the exact same order, with 'whatever counsel he took, be it his personal advisor, or whomever, would it pass?"
