#1 the countries/orgs the OP is referring to already commit war crimes, but are not part of any treaty which binds them.

#2 should we fight with our hands tied behind our backs against forces willing to go to extreme ends? Or should we unfetter ourselves for a short while to deal with an extremist threat in a more decisive manner?

OP isn't talking about just killing terrorist. Our hands aren't tied when it comes to killing them. They are not safe anywhere on earth, as we have flying deathbots dropping bombs on them everywhere. Navy Seals will pop into your crib in Pakistan and shoot you in the face (Hooah).

The OP means attacking non-terrorist and non-combatants and using political terror as a tool ourselves to fight terror. It is a self-defeating strategy.

Geneva convention stops countries from using human shields and executing prisoners of war, it's not really infringing on our capability to defeat ISIS.
