Debatable that the two where spies, holding a letter offering to use his experience in Iran to assist friendlier relation hardly seem espionage, assuming Iran has friendly intentions in their relation with the USA. Couldn't find any specific charges against the marine.
The problem is the 400million owed to Iran was supposedly spent on settling lawsuits against Iran in 2000.
well honestly i didnt digged that much, and now, reading that information, im starting to seriously doubt about anything regadring this event:

The scenario is worthy of a spy film: bundles of money, euros and Swiss francs, for an amount representing 400 million from European central banks are arranged on pallets and then loaded into a cargo , destination of Iran.
The official version...
US officials acknowledge sending the money. But they deny any involvement in the payment of a ransom. Mark Toner, spokesman for the State Department, has stressed that "pay ransoms for hostages is contrary to US policy."
Washington says it would therefore be the repayment of debt dating back to the 1979 Islamic Revolution While the two countries broke off diplomatic relations in 1980, it was in January 2016, after the implementation of the Agreement on Iran's nuclear, Obama said he wanted to repay the amount in question.
