in this context it is talked about as legal right, not a human right

the issue is not human right vs human right, it is legal right vs human right

if you look at conscientious objection as a human right, then obviously the legal system will have its way on what is right and what is wrong, therefore judge would be wrong

...which should produce the same result ( although the Pope specifically called it a human right ) . If she has a legal right to deny the licenses she can not be prosecuted .

so i haven't really paid attention to this case at all.

after she denied said licenses was she prosecuted or just stripped of duties.

She was jailed for contempt after refusing a judges order to issue the licenses .

being up to date with latest news would be nice, but sometimes real life events take precedence. interviewing for residencies becomes very time consuming =)

if a mailman has a conscientious objection to walking on snow and is refusing to deliver mail as a result, i don't think he should go to jail, but i certainly think he should be relieved of duty.

same in this situation, if she's unfit to fulfill legal responsibilities, she should be replaced with someone who can do the job. jail time seems a bit much for me.

She's an elected official who can only be removed by a public vote which is why things played out the way they did. If she had resigned none of this would have made news.

...except that in this case she can only be removed by impeachment as an elected official hence the dilemma .
