Well...keep looking, I suppose you could find someone who wants all of the "moral" aspects of society without being religious, but morality is the main reason people fight against it, and as its not guarenteed in the Constitution, nor are they being discriminated against...it is up to us, the voters.
Black - No, it will be very close. It is not afforded by constitutional rights, so they must go through the people. The Supreme Court of California overturned a 60%+ vote of the people banning gay marriage, it will almost certainly go back on the ballot in November, and ban it once more...if that happens, its permament, and the Californian Courts cannot overrule it.
