Is it based on char lvl > difficulty or ilvl < diff???

it's based on char lvl eg. 86+ has a chance for finding +2 ammy's

any npc with gamble ability, the higher ur lvl the better!

No, it depends on what you want to gamble, for hots level 11 is best for example.
