Just because 2 user's are selling the same item doesn't make HacksSkreams item unperm. If it does turn out to be unperm (with proof), which it hasn't yet, then I am sure he will refund. Otherwise, like 99% of sales on this website, it is final.

e: As stated above, this game runs on a randomized system. 2 items spawning with the same stats isn't unheard of.
