Both are true. Leveling your merc doesnt improve his stats and norm > nm > hell.

No, merc's skill depend solely on their level on the difficulty they originated from. A merc you hired at level 1 in normal and leveled to 99 will have the same stats as a merc of the same type hired at level 99 in normal.

Only difference being that mercs hired in normal have higher stats than those hired in nm who in turn have higher stats than those hired in hell. So unless you need a specific ACT2 NM aura you should hire the merc in normal.
